This regulation was developed by the Centers for Medicare and Medicaid Services (CMS).
The main goal is to maximize opportunities for people with disabilities receiving HCBS to have access to the benefits of community living.
The rule stipulates that people receive HCBS in the most integrated setting.
It is also meant to ensure that states meet their obligations under the Americans with Disabilities Act (1990) and the Supreme Court decision in Olmstead v. L.C., 527 U.S. 581 (1999).
