HCBS Final Settings Rule:

• This regulation was developed by the Centers for Medicare and Medicaid Services (CMS).
• The main goal is to maximize opportunities for people with disabilities receiving HCBS to have access to the benefits of community living.
• The rule stipulates that people receive HCBS in the most integrated setting.
• It is also meant to ensure that states meet their obligations under the Americans with Disabilities Act (1990) and the Supreme Court decision in Olmstead v. L.C., 527 U.S. 581 (1999).
